Can I open my motorcycle shop, in my house backyard big shed?

February 12th, 2013 5 comments

I just registered dealer,repair licence.

and I have abn number.

If they(licences) are approved, Can I open my shop in shed?
i am in the City Centre Development zoning

You’ll have to check the "zoning laws" in your area.
There are residential and commercial properties.
If your property is not "zoned" for commercial use, it is illegal to operate a business on your property.
Must pass fire safety rules – fire extinguisher every 20 feet (check the laws with your local fire marshal).

You will also need a license to handle hazardous materials.
Gasoline
Oil – replacing a clutch is under the rules of oil.
Parts cleaner
Contact cleaner
Brake fluid
Anti-freeze
Fire proof container to store chemical absorbed rags.

Your business must be insured.
Not only for you, but for a customer that gets hurt on your property.
If a biker gets hurt due to a repair you performed – you will get sued.

You should have insurance in case you damage a bike while in your possession – or if it should get stolen, you are responsible.
If you scratch a bike’s custom paint job – be repaired to shell out the money to have it repainted.

Just giving you a heads up as to what you are getting yourself into.

Does a cam belt really need changing every four years??

February 2nd, 2013 17 comments

I bought a VW Golf in September (04 reg) from my local VW dealership and have just had a letter saying that as my car is now four years old, i should have the cam belt replaced at a cost of at least £270. Is this normal and more importantly is it necessary. The car has done 39,000 miles. Please help as i don’t want to spend money unnecessarily.

It’s cheap insurance if you change the cam belt according to manufacturer’s recommendations. If the thing breaks, there’s a good possibility of internal engine damage that would cost much more to repair than it does to replace the belt on schedule.

What’s the point in trading in an old banger for one of those eco panda things?

January 4th, 2013 6 comments

why would someone want a new car instead of the faithful retainer that is car tax exempt, doesn’t cost much to repair or service and runs ok.
4995 on the road eh? at oh yes 16.9 apr after the first yr, isn’t that just encouraging more debt to be built up 3years down the road?

The only people who would use the scheme are those who were going to, and who could afford a new car anyway.
Can you imagine someone who has driven old bangers all their lives, whose probably driving an m reg escort, having enough cash for a new car?

No neither can I, and what about the people with a large family (like me), I need a seven seater, how can I get one of them with an engine less than 1000cc?

Course I could always but two hybrids and pay 2 lots of insurance and emit 2 lots of emissions.

Nah!, I’ll stick with my old banger as well!

cheers

How does it work with car insurance start and end times?

December 29th, 2012 4 comments

I had a car accident on the 22nd December. I was driving past the local hospital entrance and some idiot started pulling straight out of the hospital entrance.

I swerved to evade him, then suddenly I heard Bang as he hit the back end of my vehicle.

I stopped, got out and took some photos of the damage, he’s not done much just dented the wheel arch, door and rear bumper a bit, but it is a lease car so will need fixing through the insurance.

The guy that hit me, seemed very incoherent, as if he’d been drinking (my two sisters who were with me at the time both thought either he’s drunk or he’s very shook up after the accident).

He explained to me that he didn’t see the give way sign when pulling out the hospital car park. There was quite clear give way line markings across the road (plus anyway he’s come to a T-Junction coming out of a car park onto a major road and not a cross roads and he’s pulled out on me even though I was half way through the junction and even though I’ve swerved he’s still hit the back end of my vehicle so regardless of whether he saw the give way line or not he’s 100% at fault)

Anyway eventually after about 10 minutes I managed to get his insurance details off him and his address (I’d already got his reg plate ‘cos that fell off in the accident – so I copied that down!). One thing he did mention about his insurance was that it expires now he looked at it and it read expires 22/12/2012 12:00 (starts 22/12/2011 00:00), but he said he’s got his new one that starts on the 23/12/2012 at home.

The accident happened at 18:20 so where does that leave us? Was he driving uninsured as his old insurance had expired and his new one didn’t start till the next day, and if it does turn out that he is uninsured what happens now? As it was his fault I don’t want to fork out, I’ve got a £90 excess on my insurance which regardless of whether he’s insured or not I’d expect him to pay at least the excess as I’ve done everything I could do to evade him. If it does turn out his insurance is invalid will I be able to sue him at least for the excess.

The damage doesn’t look too bad and will probably just pull out and need repainting without replacing the panels, but that all depends on whether that’s acceptable to the lease company.

Also will this accident affect my insurance premiums at all because it does seem a bit unfair if it does ‘cos I’ve done everything possible to evade the accident.
Ok just got in touch with my insurance company now, they checked and he had switched insurance providers but thankfully his new insurance company had taken over by the time of the accident.

My insurer, RSA Motability, have waived the excess and are sorting out the repair in the new year.

They were so kind and helpful when I phoned them this morning.

At the moment the vehicle we get is on the motability car scheme so they sort out the insurance premiums and everything themselves, but next year were thinking of leaving that scheme and getting our own car so we were just concerned whether it would affect the premium next year when we’re paying. It appears from Swiftcover it will add £100 extra to our premium next year (the quote we got from them was £645 with the accident or £534 without the accident for the type of car we’re looking at getting – next year we’re looking at a Volvo V40)
Btw also thanks for the advice about reporting it to the police – first thing I did when I got home was phone the police and report it, got a crime reference and everything for it (seems just a bit of formal red tape really).

Normally car insurance starts and ends at midday so his new year’s cover should have began as soon as his old one expired. Unless he had changed insurance companies then that will have been automatic. His policy number will also be the same.

If he had made a mistake and was not insured for that period of 12 hours then he was committing a criminal offence by driving at 18:20. He can be prosecuted for this and fined as well as having to pay for damage to your car. Report the accident to the police asap and get a reference number just in case it turns out that he was not insured.

If you have comprehensive insurance then your own insurance company will pay for the damage to your car and seek to recover the money from the other driver. If the accident is proved to be "no fault" on your side AND they succeed in getting it back from him then your No Claims Discount should be restored. If your NCD is fully restored then your renewal premium will not be affected and will only increase by the regular annual inflation figure.

Your excess is another matter. That is a voluntary arrangement where you agree to pay the first £90 of any claim regardless of how the accident happened. Most comprehensive policies also include "legal" cover which is intended for exactly this sort of thing. The legal protection wil pay for a solicitor (the insurance company must appoint or approve them – don’t go engaging a lawyer of your own) to sue the other party to recover your excess amount. They’ll also seek to recover money that you spent on taxis, bus and train fares for when your car was being repaired.
Check your policy wording carefully to see if you have legal cover. If you don’t have it then get it next time – it’s well worth paying the extra small premium for next year.

If he is uninsured and you don’t have legal protection insurance then it’s probably not worth your while suing him privately for the recovery of your £90. Solicitors charge at least £200/hour and so for that amount of money you probably wouldn’t even get one of the television "no win no fee" merchants to help you. Your best chance to get the money back would be to add it as a claim when the police take him to court for being uninsured. Ask the magistrate to give him a court order to refund you. Discuss this with the police lawyer if it is necessary.

How do I put a total loss car back on the road?

December 5th, 2012 2 comments

My M reg granada was recently written off because of a dent in the wing and a crack in the bumper, thanks to an idiot reversing into me at a junction….. I retained the salvage and was wondering what I have to do to get it back on the road?
p.s, it was a cat D write off for uneconomical repair, nothing dangerous.

If the salvage is owned by you (i.e not the insurance company) then all you have to do is get the damage repaired – a dent in the wing and a cracked bumper is not a big job for a garage (chassis damage would be an instant write off). Firstly register your car as ‘off the road’ i.e you do not have to pay the car tax, secondly recover any remaining car tax on the car (contact the DVLA – information about doing this is on the back of the disc), thirdly park your car off road or at the garage that will be doing the repairs. Personally I wouldn’t bother with the wing damage unless it has affected the electrics. Then get the garage that has done the repairs to give the car an MOT, contact the DVLA with the MOT certificate and they will either (usually the case) re-issue your registration or issue another one. Re-tax the car (main post offices can supply a form to do this). And last, but not least, pursue the prat that damaged your car. Many insurance companies give DAS as standard on their policies and they will do most of the work for you. Hope this helps – a git hit my car and drove off (I was fully comprehensive and DAS sorted the majority out but I still lost a lot of my no claims discount). Good luck !

Setting up a foreign FAA FAR 145 repair station?

November 20th, 2012 3 comments

I am wondering what it would take to set up a foreign FAA part 145 repair station. Country in question will be the UK. Doing line work only, at 2 stations looking after 2 aircraft at each station.
What will it take, where would somebody start?
How many people need to be in charge?
Anybody have any idea of cost?
Could it even be done with one person?
Do you use IA’s for commercial work?

You would have to set up the repair station in the country where located, following their rules, while incorporating IASA (International Aviation Safety Assessment program) or BIASA (Bi-lateral Aviation Safety Agreement) regulations, to be able to work on US registered aircraft. I think the cost would be prohibitive unless you have a small fortune, primarily due to insurance costs. I’m not sure what the going rate is, but I looked into it years ago for the US and I believe, that then, where I was looking at, I had to have 3Mil in liability insurance and the annual premium was about 25k (premium may be skewed, because it was a number of years ago). You would only need one person at each airport, but that’s not really practical, Regualtory-wise, you’ll have many requirements to satisfy and it would probably take at least a year or two, to get all the issues resolved for certification. All you need is an A&P or foreign issued license with appropriate ratings for airframes/engines working on, but the IA referenced by the other gentleman is not even considered in an air carrier world, that’s a GA/corporate requirement.

In Florida, How long do you have to register a used vehicle from a private seller?

November 16th, 2012 1 comment

I am buying a vehicle in Florida from a private seller that is 2 hours away. When I get there, it will be too late in the day to register the vehicle and get a tag and I don’t want to get a ticket or any other trouble for it. I already added it to my insurance. I will be registering the vehicle the very next day.

So I guess my real question is, will I be okay driving it for one day without a tag and not getting a ticket if the police pull me over? Thanks all!

It really depends on the officer, if you happen to get pulled over. But, I personally wouldn’t worry about it. I would just make sure you take any supporting documents along with you. For instance, the title for the vehicle with a signature and date of transfer. You say you have contacted your insurance company, so if neccesary he/she can verify that as well.

Since you’ll now be a proud owner of a "new" car, a good place to know about is: http://www.autorepairinflorida.com/Category/Auto-Repair/ Although, hopefully you won’t have any car troubles for some time to come!

Congrats on your car!

Do I have to register my home business to CA?(iPhone repair)?

May 8th, 2012 3 comments

I am wondering whether I have to get a license or something to run the home business (1person).
Also, is it ok to create company logo and name without registering to the state?
If I have to, what are the steps for it?

You need a business license which is cheap and you get it from your city, should be at your city hall.

Next since you are not selling a product you don’t need a resale permit but if you decide to sell a product you need one which means you would need to collect and pay sales TAX.

If you use your name as a business name you don’t need to file for it (I.E. John Smith Enterprises) but if you want a separate business name you need to file for a fictitious business name (small fee and filling out some forms from a courthouse). If you don’t file for the name then down the line anyone can file the same name and force you to stop using it (he who files first has legal rights to it).

As for a logo, that’s 100% up to you. You don’t have to register the design but if you think you might end up very big then you could file for a trademark (less than 15% of businesses file).

It’s a good idea to get insurance but it’s not mandated.

What do I need to do a business in computer repair? Do I need a DBA? License?

March 2nd, 2011 1 comment

I want to do a home business in computer repair, can any body help me please? I need to register? What do a i need to do??? Please anybody help me.

1) Contact an attorney and set up an S corporation. The attorney can tell you whether you’ll need a license in your state/county. A DBA isn’t secure enough. Make it an S corp or LLC at the least.
2) Contact your state tax office and get your Sales Tax Id
3) Make friends with a good accountant who will tell you want is due and when it is due. What paperwork you have to file, and when to file it.
4) Get general liability insurance. It won’t cover you if somebody sues you for destroying the data on their computer, but it will if somebody slips and falls on your premises or if you’re in a car crash while carrying somebody’s computer.
5) Decide what your niche is and how to market your business.
6) Write a business plan. On second thought, do this first.
7) Prepare to wait 3 to 6 months for the first week of work.

I purchased a car that was registered in NV, bought the car at an insurance auction and have repaired the car and have the receipts and such. The title is still a NV title also. What process do I have to go through to register this vehicle? Thanks.
